Kaway'an EcoPark Rules and Waiver

BY AGREEING TO THIS DOCUMENT, YOU ARE PROVIDING YOUR WAIVER AND CONSENT FOR AND YOUR ACCOMPANYING MINORS (IF ANY) AS SET OUT BELOW.

1. Acknowledgment of Risks

I understand and acknowledge that the Activities involve inherent risks, dangers, and hazards, including but not limited to inclement weather conditions, slipping or falling, equipment failure or misuse, unpredictable animal behavior, and other circumstances naturally associated with recreational outdoor activities.

I acknowledge that KEP/CBDI has installed all precautionary measures necessary for my safety and well-being. However, I understand that the risks involved in the Activities may result in personal injury, illness, permanent disability, or death, as well as damage to or loss of personal property.

In the event that I should require medical care or treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.

 

2. Assumption of Risk

I freely and voluntarily assume all risks, known and unknown, foreseeable and unforeseeable, associated with my participation in the Activities.

 

3. Safety Briefing and Instructions

I confirm that all safety precautions, rules, and instructions related to the Activities have been clearly explained to me. I agree to follow all instructions, guidelines, and safety measures provided by KEP/CBDI and its staff at all times.

 

4. Medical Fitness

I confirm that I am physically and medically fit to participate in the Activities and have no condition that would increase my risk of injury. I understand that KEP/CBDI is not responsible for providing medical care.

5. Release and Waiver of Liability

By this Waiver, I assume any risk for myself and those I am responsible and take full responsibility and hereby release, waive, and discharge KEP/CBDI, its owners, employees, contractors, and representatives from any and all claims, demands, actions, or causes of action arising out of or related to any injury, loss, damage, or death that may occur as a result of my participation in the recreational Activities in the Park, including but not limited to those caused by terrain, facilities, temperature, weather conditions, the physical condition of participants, equipment, and the actions of others, including but not limited to participants, spectators, and KEP/CBDI personnel.

In the event that any damage to equipment or facilities occurs as a result of my or my family's willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or recklessness.

 

6. Minors

The Participant, being under the age of 18, I hereby sign this waiver as his/her parent or legal guardian, who agrees to all terms herein on behalf of the minor.

 

7. Acknowledgment and Signature

I have read this waiver carefully, fully understand its contents, and sign it voluntarily. I understand that by signing this document, I am giving up certain legal rights.

I hereby confirm that this Waiver and Consent is written in a language fully understood by me. I acknowledge that should I have questions pertaining to this Waiver and Consent, I am free to seek clarifications from the appropriate representatives of KEP/CBDI.

 This Waiver and Consent shall be governed by and construed in accordance with the laws of the Philippines and the courts of Cavite, Philippines shall have exclusive jurisdiction over any dispute arising in connection with this Waiver and Consent. If any portion of these Terms are found to be void or unenforceable by Philippine law, the remaining portion shall remain in full force and effect.
